The Fred Hollows Foundation (USA) (‘we’, ‘us’ ‘our’ and ‘Foundation’) are committed to protecting and respecting the privacy of everyone we interact with, whether that is general population, partners, donors or staff members. This Privacy Statement (‘Privacy Statement’) applies only to the collection and processing of personal data by us in the United States. It is supplementary to, and should be read in conjunction with, The Foundation’s Privacy Policy (‘Privacy Policy’) which is based in Australian law. To the extent of any inconsistency between the Privacy Policy and the Privacy Statement, the Privacy Statement will prevail in respect of personal data collected or processed in the United States.

In this Privacy Statement, the following definitions from the Privacy Policy apply:

Personal Information is any information or opinion that can identify or be used to identify an individual or is Sensitive Information that has been de-identified. The Foundation collects Personal Information about you where it is reasonably necessary for us to perform one or more of our functions or activities.

Sensitive Information is a subset of Personal Information and includes information or an opinion about an individual's racial or ethnic origin, political opinion, religious beliefs, philosophical beliefs, sexual orientation or criminal record, financial details, and genetic information or health information (being any personal information about an individual’s health or disability). By providing health or other Sensitive Information to The Foundation, an individual consents to The Foundation collecting this information and using and disclosing it for the purposes outlined in the Privacy Policy and this Privacy Statement.

Collection of Personal Information

Personal Information may be collected either directly from you or from third parties in the manner and of the types outlined in the Privacy Policy.

Do not provide Personal Information about others unless you are authorised or required to do so by contract or applicable law. You may provide Personal Information on behalf of another person if you have provided them with notice by way of a copy of the Privacy Policy and this Privacy Statement, and obtained their explicit consent. We may ask you to provide evidence of that notice and consent.

Our websites are not intended for minors (individuals under the age of 13), and we do not knowingly collect Personal Information from minors. If you become aware of any Personal Information we have collected from a minor, please contact us. If we learn that we have collected Personal Information from a minor, we will take steps to delete it without notice as soon as possible.

Use of Personal Information

Personal Information may be used in the manner and subject to the conditions outlined in the Privacy Policy.

Retention of Personal Information

We are an international organisation with information sharing between our global offices. This means your Personal Information may be shared with our offices outside of the United States and may be stored either in the United States or in another country where we or our external contractors are located or have facilities. We will comply with privacy legislation and laws in those locations and our standard practice requires external contractors by written agreement to comply with local laws and, where feasible, our security guidelines and the Privacy Policy.

We will store your Personal Information until it is no longer needed to fulfill the purpose for which it was collected or as otherwise required or permitted by law. After such time, we will either delete or anonymise your Personal Information or, if this is not possible, we will securely store your Personal Information and isolate it from any further use until deletion is possible. We may also dispose of any data in our discretion without notice, subject to applicable law.

Disclosure of Personal Information

Personal Information may be disclosed in the manner and subject to the conditions outlined in the Privacy Policy. This means that our suppliers, service providers, contractors and partners may access and use your Personal Information. Our standard practice requires these third parties by written agreement to comply with local laws and, where feasible, our security guidelines and the Privacy Policy.

You also consent to us disclosing your Personal Information and Sensitive Information outside of the United States for the purposes outlined in the Privacy Policy and this Privacy Statement.

Security of Personal Information

The steps outlined in the Privacy Policy will be taken to ensure the security of Personal Information.

Access or correction of Personal Information

Access to, corrections or removal of Personal Information will be handled in accordance with the Privacy Policy except that we require that the period allowed for processing of a request is extended to 30 days.

Anonymity

You have a right to request to deal with The Foundation anonymously or through a pseudonym as outlined in the Privacy Policy.

Online donations

Donations made online via The Foundation’s US website are processed in the US in US Dollars or, where the option has been selected by you, in a selected cryptocurrency. If you make a donation via our US website, the transaction may be handled by our service providers or third parties responsible for processing your transaction (’Payment Processors’). Please be aware that Payment Processors have their own privacy policies and those terms will apply to you regarding how that Payment Processor handles your personal data. Depending on your donation, it may be made via The Foundation’s US website or you may be re-directed to a third-party site for payment. If your donation is made via our US website, in order for the Payment Processor to process your transaction, we may require payment, credit card, or other credit-related information. If you are re-directed to a third-party site for your donation, please be sure to review any linked policies provided during payment processing as they will apply to you.

We use cookies as outlined in the Privacy Policy.

Links to other websites

Our website may contain links to and be linked by third party websites that are not under our control. As outlined in the Privacy Policy, The Foundation is not responsible for any practices on these websites that might breach your privacy and the Privacy Policy and this Privacy Statement do not apply to them.

Website traffic

We use analytics tools to track visits to our website as outlined in the Privacy Policy.

Job applicants

Personal Information and Sensitive Information may be collected when you apply for employment with us and will be handled as outlined in the Privacy Policy.

Before providing us with a resume, please remove any data such as government-issued identification numbers, financial information, photos and date of birth. We do not require or wish to receive this type of Sensitive Information in a resume.

Privacy data breach obligations

Please contact The Foundation if you become aware of any breach of security. If reasonable grounds establish there has been a Personal Information security breach, we will comply with all our obligations and responsibilities under all relevant local privacy and data breach laws, including any obligation to notify you of any security breach and take effective remedial action to protect your Personal Information.

Making a complaint

You may make a complaint or report any concerns regarding the protection of your privacy as outlined in the Privacy Policy. Please note that the Australian Information (Privacy) Commissioner will not be able to receive complaints concerning the collection and processing of personal Information in the United States.
